By posting material, you warrant and represent that you own the copyright with respect to such material or have received permission from the copyright owner. In addition, you grant The Jewish Federations of North America and FedCentral participants the nonexclusive right and license to display, copy, publish, distribute, transmit, print, and use such information or other material, but neither The Jewish Federations of North America nor FedCentral participants may sell, resell or exploit for any commercial purposes such information or other material. Neither The Jewish Federations of North America nor its representatives pre-screen content, but The Jewish Federations of North America reserves the right (but not the obligation) in its sole discretion to take whatever action The Jewish Federations of North America deems appropriate if any posting that is inconsistent with these Guidelines is brought to its attention including, but not limited to revocation of FedCentral privileges.
ASSET LIBRARY TERMS OF USE
Licensed Use
Unless stated otherwise, The Jewish Federations of North America grants to licensee a nonexclusive, non-sublicensable, non-transferable and non-assignable right to use and reproduce the images on FedCentral.org.
Restrictions
Images may not be used in any defamatory, libelous or otherwise unlawful manner. Photos used in advertising or direct mail appeals, and expressly marked as available for advertising use, are licensed for limited and nonexclusive use by federations for the period of 1 year.
Other images may only be used in an educational editorial manner, relating to events that are newsworthy or of public interest, and may not be used for any commercial, promotional, advertising or merchandising use.
Under no circumstances may an image ever be altered, changed or tampered with, either manually or electronically without JFNA's express written permission.
Photo credit and intellectual property
Copyright
JFNA's contributing photographers own the copyright in and to the images as works for hire. No ownership or copyright in the image shall be transferred. The following photo credit must appear adjacent to the use of images: "[copyright Year, Photographer's Name]/The Jewish Federation of North America. All other rights reserved." The Jewish Federations of North America is a registered trademark of The Jewish Federations of North America, all rights reserved.
Licensee will immediately notify JFNA if he/she becomes aware or suspects that any third party is wrongfully using any images in whole or in part, or is violating any of JFNA's intellectual property rights, including, but not limited to copyrights and trademarks.
Indemnity
Licensee shall defend, indemnify and hold JFNA, its officers, directors and employees and the contributing photographers harmless from all damages, liabilities, and expenses arising out of or as a result of claims by third parties relating to licensee's use of any image or any breach of this agreement.
